Terms of Service

Operator: Aloha Rush LLC dba ManaRush Guarana USA / Mana Rush Guarana (“Aloha Rush”, “we”, “us”, “our”)
Covered sites: suddenrushguarana.com, manarushguarana.com and any site that links to these Terms (the “Site”).

By accessing the Site and/or purchasing from us, you agree to these Terms. If you do not agree, do not use the Site.

SECTION 1 – ONLINE STORE TERMS

  • You represent that you are at least the age of majority in your state or province, or you are the parent/guardian consenting for a minor dependent to use the Site. Purchases must be made by individuals 18+.

  • You may not use the Site for any unlawful or unauthorized purpose.

  • You must not transmit malware or destructive code.

  • Any breach of these Terms may result in immediate termination of access to our Services.

SECTION 2 – GENERAL CONDITIONS

  • We reserve the right (consistent with applicable law) to refuse service or orders and to limit quantities.

  • Content you transmit (excluding full payment card data) may travel over networks unencrypted and be modified to meet technical requirements. Payment card data is always encrypted by our processor(s) during transfer.

  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our written permission.

  • Headings are for convenience only and do not limit these Terms.

SECTION 3 – ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

  • Site material is provided for general information and may not be current. You rely on it at your own risk.

  • We may modify Site content at any time with no obligation to update any information.

SECTION 4 – MODIFICATIONS TO SERVICE & PRICES

  • Prices may change without notice.

  • We may modify or discontinue the Service (or any part) at any time without notice.

  • We are not liable to you or any third party for modifications, price changes, suspensions, or discontinuance.

SECTION 5 – PRODUCTS & SERVICES

  • Some products/services may be available exclusively online and in limited quantities.

  • We aim to display product colors/images accurately, but your display may vary.

  • We may limit sales to any person, household, region, or jurisdiction and may limit quantities per order.

  • Descriptions and pricing are subject to change at any time, at our sole discretion.

  • We may discontinue any product at any time.

  • We do not warrant that the quality of products/services will meet your expectations or that errors will be corrected.

SECTION 6 – ORDER ACCEPTANCE, BILLING & ACCOUNT INFORMATION

  • We may refuse or cancel orders (e.g., suspected fraud, reseller activity, pricing/stock errors).

  • If we change or cancel an order, we may attempt to notify you via email/phone/billing address.

  • You agree to provide current, complete, and accurate purchase and account information and to promptly update it.

  • Risk of loss and title pass to you upon our delivery to the carrier (FOB shipping point), except where prohibited by law.

SECTION 7 – SUBSCRIPTIONS & AUTO-RENEWALS (IF ENABLED)

  • By starting a subscription, you authorize recurring charges to your payment method at the stated interval until you cancel.

  • We will disclose the recurring amount, frequency, and how to cancel at checkout and in emails.

  • How to cancel: follow the “Manage Subscription” link in your account/email or email info@ManaRushGuarana.com before the next renewal processes.

  • Once a renewal is processed/shipped, cancellation applies to future renewals.

  • We may change subscription pricing; we will notify you in advance and give you a chance to cancel.

SECTION 8 – SHIPPING, DELIVERY & INTERNATIONAL ORDERS

  • Shipping times are estimates; delays can occur.

  • For international orders (if offered), you are responsible for customs, duties, taxes, and import compliance.

  • If a package is undeliverable/returned due to address issues, we can reship (additional postage may apply) or refund the product price per our Return Policy.

SECTION 9 – RETURNS, REFUNDS & EXCHANGES

  • Returns/exchanges are governed by our Return & Refund Policy, which is incorporated by reference and available on the Site.

  • For ingestible products, opened/unsealed items are typically not eligible for return except where required by law for damaged, defective, or mis-shipped orders.

SECTION 10 – PROMOTIONS, COUPONS & GIFT CARDS

  • Promotions/coupons may have time limits, limits per customer, exclusions, and no cash value.

  • We may cancel or modify promotions at any time.

  • Gift cards are not reloadable, not refundable, and not redeemable for cash except as required by law.

SECTION 11 – THIRD-PARTY TOOLS & LINKS

  • We may provide access to third-party tools “as is” without warranties or control.

  • Third-party links may lead to sites we do not operate; we are not responsible for their content, policies, or practices.

  • Your use of third-party offerings is at your own risk and subject to the third party’s terms.

SECTION 12 – USER CONTENT, REVIEWS & FEEDBACK

  • If you submit ideas, reviews, photos, comments, or other content (“User Content”), you grant us a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works in any media for marketing, operation, and improvement of the Service.

  • You represent that you own or control the rights to your User Content and that it does not violate rights or laws.

  • We may monitor, edit, or remove User Content that violates these Terms, but we are not obligated to do so.

SECTION 13 – PROHIBITED USES

You may not use the Site or its content:
(a) for any unlawful purpose; (b) to solicit unlawful acts; (c) to violate regulations, rules, laws, or ordinances;
(d) to infringe our or others’ IP rights; (e) to harass/abuse/defame/discriminate; (f) to submit false or misleading info;
(g) to upload or transmit viruses/malicious code; (h) to collect/track personal information; (i) to spam/phish/pharm/pretext/spider/crawl/scrape;
(j) for obscene/immoral purposes; or (k) to bypass or interfere with security features.
We may terminate access for violations.

SECTION 14 – MEDICAL & WELLNESS DISCLAIMER (IMPORTANT)

  • Our products and Site content are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease.

  • Consult a qualified healthcare professional before using any supplement, especially if you are pregnant/nursing, have a medical condition, or take medications.

  • Individual results vary. Misuse may be harmful. Follow label directions. Keep out of reach of children.

SECTION 15 – INTELLECTUAL PROPERTY

  • The Site and its content (text, logos, graphics, images, software) are owned by us or our licensors and are protected by IP laws.

  • You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use.

  • Any use not expressly permitted is prohibited.

SECTION 16 – ERRORS, INACCURACIES & OMISSIONS

  • Occasionally there may be typographical errors, inaccuracies, or omissions (e.g., descriptions, pricing, availability).

  • We reserve the right to correct such errors and to change/update information or cancel orders if any information is inaccurate at any time without prior notice (including after submission).

SECTION 17 – DISCLAIMER OF WARRANTIES

  • The Service and all products are provided “as is” and “as available” unless we state otherwise in writing.

  • We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable.

  • To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

SECTION 18 – LIMITATION OF LIABILITY

  • To the maximum extent permitted by law, Aloha Rush and its officers, directors, employees, agents, contractors, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits/revenue/data/use, arising from your use of the Service or products.

  • Cap on damages: Our aggregate liability to you for claims relating to the Service or products will not exceed the **greater of (a) US $100 or (b) the amount you paid to us for the product(s) or Service giving rise to the claim during the twelve (12) months before the claim.

  • Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted by law.

SECTION 19 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Aloha Rush and its affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand (including reasonable attorneys’ fees) arising from your breach of these Terms or violation of law or third-party rights.

SECTION 20 – DISPUTE RESOLUTION; ARBITRATION; CLASS-ACTION WAIVER (U.S.)

  • Informal resolution first: Contact info@ManaRushGuarana.com to try to resolve any dispute within 30 days.

  • Binding arbitration: Except for small-claims court matters and claims seeking injunctive relief for IP misuse or unauthorized access/abuse of the Service, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration under the Federal Arbitration Act and administered by AAA (Consumer Rules) or JAMS (Consumer Minimum Standards), conducted in Honolulu County, Hawaiʻi (or remotely, if allowed).

  • Class/representative actions waived: You and we waive any right to a jury trial and to participate in a class, consolidated, or representative action. Arbitration will be conducted on an individual basis only.

  • Opt-out: You may opt out of arbitration/class waiver within 30 days after first accepting these Terms by emailing info@ManaRushGuarana.com with subject “Arbitration Opt-Out” and your full name, address, and order number (if any).

  • This Section survives termination of these Terms.

SECTION 21 – SMS/MMS & ELECTRONIC COMMUNICATIONS (IF ENABLED)

  • By opting into SMS/MMS or providing your phone number, you consent to receive recurring autodialed or prerecorded marketing messages at the number provided. Consent is not a condition of purchase.

  • Message & data rates may apply. Message frequency varies.

  • To opt out: reply STOP; for help, reply HELP or email info@ManaRushGuarana.com.

  • By using the Site, you also consent to receive electronic communications (emails, notices) and agree that all agreements, notices, and records we provide electronically satisfy legal requirements.

SECTION 22 – EXPORT, SANCTIONS & COMPLIANCE

  • You agree to comply with all export control and sanctions laws. You may not use or export products in violation of U.S. laws or to prohibited persons/regions.

SECTION 23 – FORCE MAJEURE

  • We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, shortages, supply chain disruptions, war, terrorism, government actions, power/Internet failures, or natural disasters.

SECTION 24 – GOVERNING LAW; VENUE

  • These Terms are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-laws rules, and applicable U.S. federal law.

  • Subject to the Arbitration section, the exclusive venue for permitted court actions is the state and federal courts located in Honolulu County, Hawaiʻi, and you consent to their jurisdiction.

SECTION 25 – SEVERABILITY; NO WAIVER

  • If any provision is unlawful, void, or unenforceable, the remainder remains in effect.

  • Our failure to enforce any right or provision is not a waiver of that right or provision.

SECTION 26 – ENTIRE AGREEMENT

These Terms, plus any policies hyperlinked on the Site (e.g., Privacy Policy, Return & Refund Policy), constitute the entire agreement between you and us and supersede prior agreements or communications regarding the Service.

SECTION 27 – CHANGES TO TERMS

You can review the latest Terms at any time on this page. We may update these Terms by posting revisions with a new Effective date. Your continued use after changes constitutes acceptance.
